By creating an account, accessing, or utilizing BOPINK (hosted at https://bop.ink), you enter into a legally binding agreement with BOPINK ("BOPINK", "we", "us", or "our"). If you do not agree to these terms in full, you must immediately cease all access to our platform.

BOPINK provides an AI-powered portrait generation studio and social creative playpen. Our services include zero-shot face-swapping, custom template publishing, community feeds, and creator monetization systems.

2. User Account Registration & Security

To access AI generation features and creator tools, you must authenticate via Google Single Sign-On (SSO) or verified email login. You are solely responsible for maintaining the confidentiality of your account credentials.

• You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use BOPINK.
• You agree to notify us immediately at [email protected] of any unauthorized access to your account.

3. Intellectual Property, Third-Party Consent & Automatic Image Deletion

Strict Consent Mandate: You are strictly prohibited from uploading source photos or imagery of any third party without their explicit, verifiable prior consent. You warrant that you possess all legal rights and consents required for any face reference image submitted to BOPINK.

Automatic Data Purge: To protect user privacy, all source reference selfies and uploaded input images are automatically deleted from active server storage files immediately after AI processing and portrait rendering are completed.

Generated Output Rights: Subject to your compliance with these Terms, images generated using your account are granted to you under a commercial digital usage license. You may share, download, and utilize your generated artwork for personal and commercial purposes.

4. Creator Economy, 30% Royalties & Payout Rules

BOPINK empowers creators to monetize prompt styling by publishing public templates:

• Royalty Rate: Creators earn a 30% commission on all credits spent by users generating images with their published templates.
• Payout Threshold: Withdrawal requests may be submitted once your unwithdrawn creator balance reaches $20.00 USD.
• Supported Networks: Payouts are settled via supported high-speed blockchain networks including TRC20 (USDT), BEP20 (USDT/BNB), TON, and ERC20 (USDC).
• Prohibited Manipulation: Botting template views or artificially inflating generation counts will result in immediate wallet forfeiture and account termination.

5. In-App Credit System & Refund Policy

BOPINK operates an in-app credit currency for rendering AI images. All purchases and credit spends are subject to our official Refund Policy:

• Purchased credits and Pro subscription plans are processed through secure payment gateways (Creem payment system).
• Purchased credits never expire. Subscription credits roll over each billing cycle as long as the subscription remains active.

6. Acceptable Use, Safety Prohibitions & Content Moderation

BOPINK maintains a zero-tolerance policy against illegal, non-consensual, or harmful content. You explicitly agree NOT to upload, generate, or transmit any content that:

• Prohibited Non-Consensual Imagery: Uploads photos of any third party without their prior consent or generates deepfakes designed to harass, impersonate, or defame real individuals.
• Prohibited Harmful Media: Contains adult NSFW/pornographic content, explicit nudity, extreme violence, gore, hate speech, or child exploitation material.
• Copyright Infringement: Infringes upon registered trademarks, copyrights, patents, or publicity rights of third parties.
• Infrastructure Exploitation: Attempts to bypass automated safety filters, reverse engineer, or exploit BOPINK API infrastructure.

7. Limitation of Liability & Disclaimers

BOPINK is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding 100% uptime or deterministic AI visual styling outputs. To the maximum extent permitted by applicable law, BOPINK shall not be liable for indirect, incidental, or consequential damages.
